This Price List, along with TelePacific's Service Agreement, contain the rates, terms and conditions applicable to the provision of Interstate and International MTS by TelePacific within the United States. Service is furnished subject to the availability of facilities and subject to transmission, atmospheric and like conditions.

The additional terms and conditions specifically applicable to TelePacific's Interstate and International MTS contained herein are incorporated into the Service Agreement's Terms and Conditions by this reference.

This Price List does not apply to services offered by TelePacific on an Intrastate basis pursuant to tariffs on file with or which are subject to the jurisdiction of any state regulatory commission.

The following definitions apply to TelePacific's Interstate and International MTS.

Authorized User - "Authorized User" means the Customer or any person employed by or permitted by the customer to access TelePacific's services. An Authorized User is responsible for compliance with the applicable rates, terms and conditions of service.

Billed Party - "Billed Party" means the person or entity responsible for payment for use of TelePacific's Service(s).

Common Carrier- "Common Carrier" means a company or entity providing telecommunications services to the public.

Customer - "Customer" means the person, partnership, association, joint stock company, trust, corporation, or governmental entity or any other entity, that is responsible for payment of charges and for compliance with the rates, terms and conditions contained in this Price List and in the Service Agreement entered into with TelePacific.

Customer - Provided Facilities - "Customer - Provided Facilities" means all communications facilities provided by the Customer and/or Authorized User other than those provided by TelePacific.

Direct Dialed Calls - "Direct Dialed Calls" means a telephone call that is automatically completed and billed to the telephone number from which the call originated without the automatic or live assistance of an operator. This includes calls forwarded by call forwarding equipment.

FCC - "FCC" means the Federal Communications Commission.

Personal Identification Number ("PIN") - "Personal Identification Number" means the code numbers used in connection with designated calling card numbers to allow a Customer to place calls.

Telecommunications - "Telecommunications" means the transmission of voice communications or, subject to the transmission capabilities of the Service, the transmission of data, facsimile, signaling, metering or any other form of intelligence.
